1. Acceptance of Terms

By accessing or using dbaBrain.ai (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your account.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to reverse engineer any aspect of the Service
• Use the Service to monitor databases you do not have authorization to access
• Share your account credentials with unauthorized parties

4. Data and Privacy

dbaBrain connects to your PostgreSQL databases to collect performance metrics, configuration data, and log information. We do NOT store your actual database content (rows, columns, user data). We store only:

• Connection credentials (encrypted at rest with AES-256-GCM)
• Performance metrics and statistics
• Database configuration parameters
• Query text and execution plans (from pg_stat_statements)
• Log entries relevant to performance and errors

5. Intellectual Property

The Service and its original content, features, and functionality are owned by dbaBrain Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain all rights to your data. We claim no ownership over the data you provide to the Service.

6. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of scheduled maintenance when possible.

7. Limitation of Liability

In no event shall dbaBrain Inc., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. The Service provides diagnostic suggestions and recommendations. All actions taken on your database systems based on these recommendations are your responsibility.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All data associated with your account will be deleted within 30 days of termination unless otherwise required by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Delaware.
